Congratulations to Dana Marjieh on obtaining dismissal of a Kings County action

The Firm congratulates Dana Marjieh on obtaining dismissal of an action venued in Kings County, Yakovetz v. 52 Arden Associates, LLC and Agua Azul Deli Grocery Corp. This action arose from an alleged trip and fall through a metal door/cover of a store aisle located between the main floor and basement of a convenience store.  Nearly a year after issue was joined, Plaintiff failed to appear for a scheduled compliance conference, and subsequently failed to prosecute the action in anyway.  Defendants served a 90 day notice as a prerequisite to filing a motion to dismiss for failure to prosecute and after the expiration of 90 days, filed the motion.  The Court granted the motion and dismissed the case.
