BMS Attorney John Bieder Obtains Dismissal in $4 Million Building Facade Collapse Case

A recent win involved the dismissal of all third-party claims against Black Marjieh & Sanford LLP’s client, an engineer, in a complex subrogation matter involving the collapse of a façade of a 34-story building in Manhattan. The plaintiff sought damages in excess of $4 million. Attorney John Bieder successfully argued for the dismissal of all claims against their client who inspected the building three years prior to the collapse based on the economic loss doctrine.

The Court agreed that the Third-Party Plaintiffs, the contractors for the subject project, could not successfully obtain common law and/or contractual indemnification and contribution from the engineer as the third-party claims were based solely on damages resulting from economic loss. The client, a well-known and respected engineer who has been working in the tri-state area for the last thirty years, was elated with the result.
