BM&S Partner James J. Lofrese Secures Summary Judgment Dismissal in Rooftop Construction Accident Case

Black Marjieh & Sanford LLP is pleased to announce that Partner James J. Lofrese secured summary judgment dismissal of all claims asserted against the firm’s client in a personal injury action arising from a rooftop construction accident.

The plaintiff, a technician, alleged severe injuries after falling from an allegedly unstable rooftop cell phone antenna mast. Claims were asserted against multiple parties, including BM&S’s client, which had arranged for servicing of the antenna array prior to the incident.

BM&S demonstrated through evidentiary submissions that its client subcontracted the relevant work, owed no duty to the plaintiff, and did not cause or contribute to the alleged accident. In October 2024, the Court accepted these arguments and dismissed all claims and cross-claims against the firm’s client in their entirety.
