BM&S Partner John Bieder Obtains Summary Judgment in Tortious Interference of Contract Action

In an action brought to recover monies paid for damages to a building, allegedly caused by neighboring construction, Black Marjieh & Sanford Partner John Bieder was able to successfully argue that the building owner did not in fact suffer any damages and the claim was essentially fraudulent.

By establishing that after the owner’s insurer paid the claim, the building was fixed at no cost to the owner, all other issues became moot as there was no damage as a result of the neighboring construction and a claim should not have been made. As such, the Plaintiff could not recover any monies from the defendants.

As a result of John’s arguments, Plaintiff not only agreed to discontinue the action, but with Prejudice.
