Nicole Aldridge-Henry Obtains Dismissal on Behalf of Grocery Store Client
In a recent case involving an alleged trip and fall in the parking lot of a grocery store, Trial Counsel Nicole Aldridge-Henry filed a motion to dismiss the suit which was thereby granted by the Court prior to depositions.
The case involved a questionable claim from the onset, as the plaintiff was observed via video surveillance giving the peace sign to a security camera immediately prior to his alleged trip and fall. Our BMS attorneys pushed for a voluntary discontinuance as the claims could not be substantiated by any evidence, and ultimately plaintiff’s attorney withdrew as counsel. We subsequently filed a motion to dismiss, bringing attention to suspicious circumstances of plaintiff’s claim. In the end, the Court agreed with our position, and granted the motion, dismissing plaintiff’s complaint in its entirety.
